All rights reserved.We present new observations of the low-mass companion to HD 984 taken with the Gemini Planet Imager as a part of the GPI Exoplanet Survey campaign. Images of HD 984 B were obtained in the J and H bands. Combined with archival epochs from 2012 and 2014, we fit the first orbit to the companion to find an 18 au orbit with a 68% confidence interval between 14 and 28 au, an eccentricity (...) of 0.18 with a 68% confidence interval between 0.05 and 0.47, and an inclination of 119°with a 68% confidence interval between 114°and 125°. To address the considerable spectral covariance in both spectra, we present a method of splitting the spectra into low and high frequencies to analyze the spectral structure at different spatial frequencies with the proper spectral noise correlation. Using the split spectra, we compare them to known spectral types using field brown dwarf and low-mass star spectra and find a best-fit match of a field gravity M6.5 ±1.5 spectral type with a corresponding temperature of K. Photometry of the companion yields a luminosity of log=2.88 ± 0.07 dex with DUSTY models. Mass estimates, again from DUSTY models, find an age-dependent mass of 34 ±1 to 95 ±4 M Jup. These results are consistent with previous measurements of the object. (shrink)

I was a doctoral student at IU then and had studied the writings of many of the conference presenters and so the experience of hearing and meeting them in person was a heady one, indeed. I will never forget those impressions of (...) Phil Alperson, Wayne Bowman, Allen Britton, David Elliott, Peter Kivy, Gerard Knieter, Thomas Regelski, Bennett Reimer, John Shepherd, Ann Stokes, Eleanor Stubley, Keith Swanwick, and many others.I was interested in meeting Michael after hearing his response to the presentation of one of my favorite IU professors of musicology, Austin Caswell. Caswell’s provocative paper, “How We Got into Canonicity and What it has Done to Us: An American Music Historian’s View of Music in Academia,” claimed that “the effect of canonicity on American musical life is destructive,” while Michael’s response was characterized by his style of writing that I came to recognize over the decades as distinct, calm, logical, methodical, and based in an extraordinarily wide and deep wealth of historical knowledge. While I greatly admired my rebellious and passionate professor’s views and temperament which were not unlike my own, I also appreciated hearing Michael’s measured and thoughtful response. Thus began my friendship with Michael, who, I learned, was not only a professor [End Page 92] and dean at Towson State University but also an avid big band woodwind doubler who showed interest in my doctoral research in the art of vocal jazz improvisation. That friendship lasted for almost twenty-eight years and we enjoyed memorable reunions at other conferences. For example, there was the ISPME conference held at UCLA where he invited me to dinner with his good friend and connoisseur of fine wines, Bennett Reimer, and the ISPME conference in Helsinki where, after I tripped and severely broke my ankle, requiring surgery, Michael, Estelle Jorgensen, Iris Yob, and two then-doctoral students (Kasia Bugaj and Leonard Tan) visited me in the Helsinki hospital.When I began teaching at the University of Southern California in 1995, it was fortuitous that Michael’s brother, Brian, lived in the Los Angeles area. His frequent visits allowed him to make several guest lectures to my graduate research methods classes, very welcome opportunities. After one of those lectures, I relayed the history of my family’s ballroom in the Chicago area that was open for business with big band music from 1929 until 1967. He asked if I had any artifacts from Madura’s Danceland, and when I mentioned my father’s stacks of dusty record books, newsletters, photos, and posters in our basement, he became very enthusiastic and told me that I had a “gold mine” of an archive with which to write a book about the place! As a trained quantitative researcher, I began to explore the record books to analyze trends in band pay over the Depression and World War II years.1 Over the next ten years, with help from Michael’s regular prodding and encouragement, I organized the large archive into the history of Madura’s Danceland.2 I owe this personally important accomplishment to Michael Mark.Michael invited me (in his endearing way which I could not refuse) to coauthor a music education textbook with him3 and our writing partnership went so smoothly that he invited me to co-author the 4th edition of his Contemporary Music Education.4 Although our writing styles and areas of expertise were very different, I learned much from his narrative approach which included illustrative scenarios, interviews, and the informal use of contractions, a style of writing that was not second nature for me. The post-Civil War American natural history craze spawned a new institution -- the natural history dealer -- that has failed to receive the historical attention it deserves. The individuals who created these enterprises simultaneously helped to promote and hoped to profit from the burgeoning interest in both scientific and popular specimen collecting. At a time when other employment and educational prospects in natural history were severely limited, hundreds of dealers across the nation provided encouragement, specimens, publication outlets, training opportunities, and (...) jobs for naturalists of all motivations and levels of expertise. This paper explores the crucial role that specimen dealers played in the larger natural history community. After briefly examining the development of local taxidermy shops in the mid-nineteenth century, it then traces the history of four large natural history dealerships established in the United States during the latter half of the century: Ward's Natural History Establishment, Frank Blake Webster's Naturalists' Supply Depot, Southwick & Jencks' Natural History Store, and Frank H. Lattin & Co. By the early twentieth century, changing tastes in interior design, the growth of the Audubon movement, and the dramatic expansion of alternate training and job opportunities for naturalists led many specimen dealers either to shift their emphasis or to shut their doors. I develop and defend a novel answer to Peter van Inwagen’s ‘Special Composition Question,’ (SCQ) namely, under what conditions do some things compose and object? My answer is that things will compose an object when and only when they exist simultaneously relative to a reference frame (I call this ‘Temporally Restricted Composition’ or TREC). I then show how this view wards off objections given to ‘Unrestricted Mereology’ (UM). TREC, unlike other theories of Restricted Composition, does not fall prey to worries (...) about vagueness, anthropocentrism, or arbitrariness. TREC also has advantages over all the other answers to the SCQ. TREC is an account an A-theorist anti-Eternalist who wants an unrestricted mereology should accept. I also engage in some conceptual hygiene by showing how UM, as it should be used, should not, in itself, entail or contain a commitment to either Eternalism or Four-Dimensionalism. (shrink)

I am the LawIt is hard to imagine two more disparate characters than Judge Joseph Dredd and Hercules J—the one an over-muscular, faceless and heavily armed street judge astride a Lawmaster motorcycle who overidentifies with his role ; the other devoid of any physical presence or image, and structurally decoupled from the execution of law by a fierce determination to maintain the separation of powers and accountability which Dredd so effortlessly ignores. Hercules J is the embodiment of an intellectualised, yet (...) creative, operationalisation of law. To the academic spirit, Hercules is infinitely preferable as a model of judicial activism: his world conjures a contemplative modality, ever alert to the requirements of rights and largely aligned with the temper of the post-Enlightenment. By contrast, Dredd is the personification of the worst aspects of law-and-order as the debased and politicised manifestation of the Rule of Law. His is an intensely visceral presence, the metonymic blindness of Themis replaced by the Dredd’s fractured eyeline: blindness as a signifier of impartiality yields to blindness as a symptom of institutional rage. This article interrogates the characters, actions and values of Hercules J and Dredd J, viewed primarily through the lens of Jacques Derrida’s Force of Law, focusing on the relationship between law and violence as it is exposed in Hercules’s and Dredd’s worlds, and then turning to judicial confrontation with the aporetic: the aporias, identified by Derrida and others, that law must confront. The interrogation continues, finally contemplating the current state of law in the common law world—the world of liberal democracies, suggesting that the high point of democracy may well have passed, and that we are on a Dredd-ward trajectory. Because any characterization of underinsurance will refer to the value judgments of people about what counts as "adequate" and "inadequate" healthcare, the goal of characterizing and measuring the underinsured is difficult to achieve. In his Introduction to (...) Logic 1 Irving Copi raises a problem with two of these definitions which he believes forces him to limit the range of propositions which can be used in the square of opposition. Since contrary propositions can both be false, but the falsity of a necessarily true proposition is not possible, a necessarily true proposition has no contrary. Therefore, only contingent propositions can be contraries. Subcontrary propositions can both be true, but the truth of a necessarily false proposition is not possible.2 This problem is rarely raised in other logic texts, but, it is interesting to note, it is mentioned by a number of neoscholastic philosophers, for example, P. It should be mentioned, however, that the position of the philosophers cited above is not entirely the same as Copi's. Recent debates about the legacy (and, sometimes, surpassing) of Derridean philosophy have often oriented themselves around questions of a new austerity in relation to the implicit philosophical functioning of God. Indeed, an increasing philosophical vigilance about the death or nonexistence of God has begun to be presented as a hallmark of recent criticisms of earlier receptions of Derrida and, by way of messianic structures of time, of Derridean politics as well. We argue that the inflating value of atheism in recent (...) texts operates most effectively within a broader forgetfulness of the many modes in which a serial dying of gods constitutes a more fundamental quality of the religio-political archive than the stability or life of these gods. We find, moreover, there to be something comical about a reconfiguration of the ontotheological archive around a tableau of serially dying Gods, this God who cannot stabilize or maintain for long any system of divine life support. Most importantly, we find that our sense of comedy is itself indicative of important shifts within the stylistics of Derridean discussions of auto-immunity and supplement which have yet to be worked through with any real seriousness. In this respect, our reflections pair Bergson's reflections on the universe as a ‘machine for the manufacture of gods’ with Bergson's explorations of comedy as a fundamentally mechanical affair. The serially dying gods of our religious and philosophical traditions are best understood in the same modes as Bergson's comedy, often marked by an automatism of everyday mechanisms of life which outlive their useful functioning. Suppose that two nations A and B each possess a nuclear arsenal and are rational utility-maximizers. Suppose further that B has some interest in provoking A, possibly by attacking her with nuclear weapons. In the hope of preventing this from happening, A informs B of à conditional intention on her part to retaliate against B with nuclear weapons should B in fact attack A. By doing so A attempts to lower the probability of B's attacking A by increasing B's estimate (...) of the conditional probability of A's retaliating once provoked. Problematic deterrent situations are those in which B prefers to attack A without retaliation, A prefers most of all that she not be attacked, and A prefers an attack-with-no-retaliation scenario to an attack-with-retaliation scenario. Feature is à result of the fact that A prefers to minimize nuclear devastation, i.e., A would herself be worse off retaliating than not retaliating to an attack. Now, if B knows all of this to be the case then A's expression of a conditional intention to retaliate will not in fact deter B from attacking, since A is rational and will not act contrary to her own best interests. B has no reason to fear A's retaliation and therefore B has no reason not to attack. Deterrence, it seems, is an irrational policy among fully rational actors. This is one version of the so-called paradox of deter-rence. If expressing a conditional retaliatory intention is the best way for A to ward off an attack, then the paradox can be strengthened as follows: It is rational for A to intend to act irrationally. Are corporate codes of ethics necessarily ethical? To challenge this notion, an initial set of universal moral standards is proposed by which all corporate codes of ethics can be ethically evaluated. The set of universal moral standards includes: (1) trustworthiness; (2) respect; (3) responsibility; (4) fairness; (5) caring; and (6) citizenship. By applying the six moral standards to four different stages of code development (i.e., content, creation, implementation, administration), a code of ethics for corporate codes of ethics is constructed by (...) which companies can be ethically audited for compliance. The newly proposed code of ethics for corporate codes of ethics was then applied to four large Canadian companies representing a variety of industries: telecommunications; banking, manufacturing, and high technology. The ethical audit of the four companies' ethics programs based on the proposed code indicates that all four companies have room to improve the ethical nature of their codes of ethics (i.e., content, creation, implementation, administration). The study examines employee, managerial, and ethics officer perceptions regarding their companies codes of ethics. The study moves beyond examining the mere existence of a code of ethics to consider the role that code content and code process (i.e. creation, implementation, and administration) might play with respect to the effectiveness of codes in influencing behavior. Fifty-seven in-depth, semi-structured interviews of employees, managers, and ethics officers were conducted at four large Canadian companies. The factors viewed by respondents to be important with (...) respect to code effectiveness include: provisions of examples; readability; tone; relevance; realism; senior management support; training; reinforcement; living up to standards; reporting requirement; anonymous phone line; communicating violations; and enforcement. The factors found to be potentially important include: justification for provisions; employee involvement; and sign-off requirements. When it comes to the establishment of an ethical corporate culture, there appear to be at least two inter-related foundational requirements: (1) the existence of an explicit set of core ethical values; and (2) the presence of ethical leadership, i.e., an ethical ‘tone at the top.’ Some companies appear, however, to have been more successful than others when it comes to establishing an appropriate ‘tone at the top’, i.e., leaders who behave according to an explicit set of core ethical values. Building on previous values-based leadership research, this study examines the process of one Canadian-based firm’s initial efforts, following a series of embarrassing scandals and negative publicity, to inculcate values-based leadership via a set of core ethical values. There appears to be an implicit assumption by those connected with the ethical investment movement (e.g., ethical investment firms, individual investors, social investment organizations, academia, and the media), that ethical investment is in fact ethical. This paper will attempt to challenge the notion that the ethical mutual fund industry, as currently taking place, is acting in an ethical manner. Ethical issues such as the transparency of the funds and advertising are discussed. Ethical mutual fund screens such as tobacco, alcohol, gambling, (...) and the military are preliminarily examined to better determine whether they can actually be defined as "ethical" screens as opposed to merely social, political, or religious screens. A code of ethics for ethical investment is constructed by which ethical mutual fund firms can be audited for ethical compliance. (shrink)

I offer an appreciation and critique of Ernst Fehr’s altruism research in experimental economics that challenges the "selfishness axiom" as an account of human behavior. I describe examples of Fehr’s experiments and their results and consider his conceptual terminology, particularly his "biological" definition of altruism and its counterintuitive implications. I also look at Fehr’s experiments from a methodological perspective and examine his explanations of subjects’ behavior. In closing, I look at Fehr’s neuroscientific work in experimental economics and question his adherence (...) to a subjective expected utility interpretation of subjects’ behavior. Ethical decision-making descriptive theoretical models often conflict with each other and typically lack comprehensiveness. To address this deficiency, a revised EDM model is proposed that consolidates and attempts to bridge together the varying and sometimes directly conflicting propositions and perspectives that have been advanced. To do so, the paper is organized as follows. First, a review of the various theoretical models of EDM is provided. These models can generally be divided into rationalist-based ; and non-rationalist-based. Second, the proposed model, called (...) ‘Integrated Ethical Decision Making,’ is introduced in order to fill the gaps and bridge the current divide in EDM theory. The individual and situational factors as well as the process of the proposed model are then described. Third, the academic and managerial implications of the proposed model are discussed. In order to gain greater insight into the nature of corporate social responsibility (CSR) during a time of crisis, the study examines the commitment of firms to continue to engage in CSR activity despite financial pressures to divert their slack resources elsewhere. The setting of the study is CSR activity during the perhaps unprecedented global crisis associated with the COVID-19 pandemic. Based on a qualitative research method approach, both a variety of media sources and the relevant academic literature are reviewed (...) in order to identify examples of CSR activity related specifically to COVID-19. The examples are then categorized and situated according to Professor Archie Carroll’s well-known CSR Pyramid framework describing the economic, legal, ethical, and philanthropic domains of CSR. As such, this study is the first to extend the rich literature stream utilizing Carroll’s CSR Pyramid within the unique context of a global pandemic. (shrink)

Journey Back to God explores Origen of Alexandria's creative, complex, and controversial treatment of the problem of evil. It argues that his layered cosmology functions as a theodicy that deciphers deeper meaning beneath cosmic disparity. Origen asks: why does God create a world where some suffer more than others? On the surface, the unfair arrangement of the world defies theological coherence. In order to defend divine justice against the charge of cosmic mismanagement, Origen develops a theological cosmology that explains the (...) ontological status and origin of evil as well as its cosmic implications. Origen's theodicy hinges on the journey of the soul back to God. Its themes correlate with the soul's creation, fall and descent into materiality, gradual purification, and eventual divinization. The world, for Origen, functions as a school and hospital for the soul where it undergoes the necessary education and purgation. Origen carefully calibrates his cosmology and theology. He portrays God as a compassionate and judicious teacher, physician, and father who employs suffering for our amelioration. Journey Back to God frames the systematic study of Origen's theodicy within a broader theory of theodicy as navigation, which signifies the dynamic process whereby we impute meaning to suffering. It unites the logical and spiritual facets of his theodicy, and situates it in its third-century historical, theological, and philosophical context, correcting the distortions that continue to plague Origen scholarship. Furthermore, the study clarifies his ambiguous position on universalism within the context of his eschatology. Finally, it assesses the cogency and contemporary relevance of Origen's theodicy, highlighting the problems and prospects of his bold, constructive, and optimistic vision. (shrink)

The paper explores the ongoing debate between the narrow version of CSR proposed by Milton Friedman and the broader version of CSR, which includes additional ethical and/or philanthropic obligations. Implications are then discussed.

ABSTRACTWhen attempting to articulate the nature and scope of corporate social responsibility , a variety of opinions emerge. The primary CSR issue appears to be: Should firms go “beyond profits”? In order to address this normative question, this article will explore the theoretical underpinnings of CSR and its practical application. Part one of the paper begins by discussing common CSR definitions. Part two outlines the CSR debate in terms of the “narrow view” of CSR versus the “broad view” . Part (...) three applies both the narrow and broad approaches to CSR in analyzing two classic business and society cases: the Ford Pinto; and Merck's river blindness pill. The article concludes with a proposed synthesis of the CSR approaches discussed. (shrink)

In this paper we examine Fehr’s notions of “altruism”, “strong reciprocity” and “altruistic punishment” and query his ascription of altruism. We suggest that, pace Fehr, altruism cannot be defined behaviourally because the definition of altruism must refer to the motives of actors. We also advert to certain inconsistencies in Fehr’s usage of his terms and we question his explanation of altruism in terms of ‘social preferences’.

Despite his enormous bibliography of written works, Ricoeur has never devoted an entire tome to either moral philosophy or ethics per se. Three chapters of one work, Oneself as Another, do, however, encompass what he calls summarily his “little ethics.” To understand Ricoeur’s ethical project, it is important to see its genesis in his earlier anthropological studies and to follow its evolving nature into a hermeneutical poetics. Ricoeur’s ethical orientation is teleological. He makes a strong distinction between ethics and morality, (...) with ethics being comprised of three inseparable components: the “good life,” the other, and justice. The essential hermeneutical nature of his ethics becomes fully apparent in his discussion of practical wisdom. (shrink)

On April 20th, 2010, an incident was to take place 49 miles off the Louisiana coast at the Macondo Prospect location in the Gulf of Mexico that would potentially change the future of offshore oil drilling. On that day, 11 men would lose their lives when the 33,000 ton Deepwater Horizon rig, owned by Transocean but leased by BP PLC, exploded. As a result of the explosion, millions of barrels of oil would be released into the Gulf of Mexico, leading (...) to widespread environmental harm and devastation to the shoreline communities. To better examine the underlying reasons for how such an event could take place in 2010, this paper will unfold as follows. First, we provide context to the oil spill by discussing the history of BP, including its transformation into an “environmental” firm in 1995. Second, we explore and analyze the catastrophe through the lens of ethics. Finally, we analyze the disaster through a comparison with the U.S. 2008 financial crisis with a view to identify the root causes of the disaster and the string of ethical failures that have scarred the market economy over the past three or four decades. . Recent corporate scandals have focused the attention of a broad set of constituencies on reforming corporate governance. Boards of directors play a leading role in corporate governance and any significant reforms must encompass their role. To date, most reform proposals have targeted the legal, rather than the ethical obligations of directors. Legal reforms without proper attention to ethical obligations will likely prove ineffectual. The ethical role of directors is critical. Directors have overall responsibility for the ethics and compliance programs (...) of the corporation. The tone at the top that they set by example and action is central to the overall ethical environment of their firms. This role is reinforced by their legal responsibilities to provide oversight of the financial performance of the firm. Underlying this analysis is the critical assumption that ethical behavior, especially on the part of corporate leaders, leads to the best long-term interests of the corporation. We describe key components of a framework for a code of ethics for corporate boards and individual directors. The proposed code framework is based on six universal core ethical values: (1) honesty; (2) integrity; (3) loyalty; (4) responsibility; (5) fairness; and (6) citizenship. The paper concludes by suggesting critical issues that need to be dealt with in firm-based codes of ethics for directors. (shrink)

Political sociologists interested in corporate power have focused increasingly on the extent to which the business community is cohesive. Studies of cohesion, however, frequently contain either no definition or operational definitions with little theoretical rationale. This paper examines the uses of the term cohesion in the power structure literature as well as in classical and contemporary sociological theory. I argue that: (1) cohesion is most appropriately defined as an objective characteristic of a social structure; (2) to understand a group's power, (...) we should focus on the extent to which its members behave similarly; and (3) the concept of structural equivalence may be as likely to capture the processes of interest to power structure researchers as the concept of cohesion. Findings from a study of corporate political behavior are presented to illustrate this argument. (shrink)

Theories of distributive justice are most severely tested in the area of disability. In this book, Mark Stein argues that utilitarianism performs better than egalitarian theories in this area: whereas egalitarian theories help the disabled either too little or too much, utilitarianism achieves the proper balance by placing resources where they will do the most good. Stein offers what may be the broadest critique of egalitarian theory from a utilitarian perspective. He addresses the work of egalitarian theorists John Rawls, (...) Ronald Dworkin, Amartya Sen, Bruce Ackerman, Martha Nussbaum, Norman Daniels, Philippe Van Parijs, and others. Stein claims that egalitarians are often driven to borrow elements of utilitarianism in order to make their theories at all plausible. The book concludes with an acknowledgment that both utilitarians and egalitarians face problems in the distribution of life-saving medical resources. Stein advocates a version of utilitarianism that would distribute life-saving resources based on life expectancy, not quality of life. Egalitarian theories, he argues, ignore life expectancy and so are again found wanting. _Distributive Justice and Disability _is a powerful and engaging book that helps to reframe the debate between egalitarian and utilitarian thinkers.
